These Terms & Conditions govern your use of the Paragonix website and all purchases made through the Website.

By accessing the Website, placing an order or completing a purchase, you agree to these Terms &
Conditions.
Before completing a purchase, customers are required to actively accept these Terms through the
checkout acceptance box.

1. About Paragonix

We, Paragonix, operate this Website and provide access to the products, information and services
available through it.
We may work with selected third-party partners, including pharmacists, fulfilment providers,
independent laboratories, payment processors, logistics providers and other specialist service providers
to support the operation of our Website and the fulfilment of customer orders.
These partners may assist with order processing, product fulfilment, independent testing, payment
handling, shipping, logistics and customer support.
Customers may contact us through the official Contact Us page for assistance with orders, products or
questions relating to these Terms & Conditions.
We may update our operational arrangements, service providers or fulfilment partners from time to time
where reasonably necessary.
Nothing in this section excludes or limits any right or obligation that cannot lawfully be excluded.

2. Eligibility to Purchase

You must be at least 18 years old, or the minimum legal age required in your jurisdiction if higher, to purchase through this Website.

• you are legally capable of entering into the transaction;
• the information supplied by you is accurate;
• you are purchasing for lawful purposes; and
• you have read and accepted these Terms.

Paragonix may refuse or cancel an order where fraud, misuse, unlawful activity or materially inaccurate
information is reasonably suspected.

3. Purchase Through Paragonix

Paragonix does not require customers to submit a prescription as part of the Website purchasing or
checkout process.
This does not mean that a product can necessarily be imported, received, possessed or used without a
prescription, permit, medical authorisation or other approval in every country.
Products may have different legal classifications and requirements in different jurisdictions.
It is the customer’s responsibility to determine the requirements that apply in their destination country
before purchasing.

4. Customer Responsibility for Importation

Customers ordering products for international delivery are responsible for determining whether those
products may lawfully be imported, received, possessed and used in their destination country.
Before placing an order, customers are responsible for checking any applicable:

  • prescription requirements;
  • personal-import rules;
  • import permits;
  • medical authorisations;
  • quantity restrictions;
  • possession restrictions;
  • customs requirements;
  • taxes or duties; and
  • requirements imposed by health, medicines, customs, border or other government authorities.


Paragonix does not provide individual legal, customs or regulatory advice concerning a customer’s
destination country.
A customer’s decision not to investigate their local requirements does not transfer responsibility for
those requirements to Paragonix.
Nothing in these Terms transfers to the customer an obligation that applicable law specifically requires
Paragonix or another supplier to perform

5. Availability Does Not Constitute Import Approval

The availability of a product on the Paragonix Website does not mean that the product is approved,
registered or legally permitted for importation in every country.
Similarly, the availability of a country as a shipping destination does not represent or guarantee that
every Paragonix product may lawfully be imported into that country.
Customers are responsible for determining the legal requirements applicable to their individual order

6. International Customer Declaration

By placing an international order, the customer confirms that:

  • they understand product classifications and import laws differ between countries;
  • they accept responsibility for requirements imposed upon them by their destination country;
  • they understand their country may impose prescription, permit or authorisation requirements even
    though Paragonix does not require these to be submitted through its Website checkout;
  • their delivery information is complete and accurate;
  • they understand customs clearance cannot be guaranteed; and
  • they accept the risks associated with international importation.

 

7. Product Information

Paragonix takes reasonable care to provide accurate product descriptions, quantities, ingredients,
photographs and other product information.
Packaging, labelling or product appearance may occasionally change.
Products supplied should materially correspond with their description on the Website.
Paragonix may correct obvious typographical, technical or pricing errors

8. Medical and Product Disclaimer

Information provided through the Website is for general product and educational purposes.
It is not intended to replace individual medical advice, diagnosis or treatment provided by an
appropriately qualified healthcare professional.
Products may not be suitable for every individual.
Customers should seek appropriate professional advice where necessary, particularly concerning
existing medical conditions, allergies, contraindications, medication interactions, pregnancy,
breastfeeding, concurrent medications or individual suitability.
No information provided by Paragonix guarantees a particular medical or therapeutic result.
Nothing on the Website authorises or encourages unlawful use of any product.

9. Packaging

Paragonix takes reasonable steps to package orders securely and with appropriate consideration for
customer privacy and product protection during transportation.
Additional paper, wrapping, sleeves or other protective material may be placed around the original
product packaging or labelling.
This may provide additional customer privacy during ordinary transportation, protect the original label,
protect the product packaging from damage and help preserve the integrity of the shipment.
The original product remains within the shipment.
Protective wrapping may be removed by customs, postal services, border authorities or another legally
authorised authority where inspection is required.
Protective or discreet packaging does not constitute a guarantee that a shipment will avoid
identification, inspection, opening, delay, detention or seizure by an authority.

10. Customs and Border Authorities

International shipments may be subject to customs, border, postal, medicines, health or other government inspection. A shipment may be:
  • opened;
 inspected;  delayed;  held;  assessed for duties or taxes;  refused entry;  returned;  detained;  confiscated;  seized; or  destroyed. Customs and government authorities act independently of Paragonix. Paragonix cannot control their decisions and does not guarantee that any shipment will successfully clear customs. A previous successful delivery does not guarantee that a future shipment will also clear customs.

10. Customs and Border Authorities

International shipments may be subject to customs, border, postal, medicines, health or other government inspection. A shipment may be:
  • opened;
  • inspected;
  • delayed;
  • held;
  • assessed for duties or taxes;
  • refused entry;
  • returned;
  • detained;
  • confiscated;
  • seized; or
  • destroyed.
Customs and government authorities act independently of Paragonix. Paragonix cannot control their decisions and does not guarantee that any shipment will successfully clear customs. A previous successful delivery does not guarantee that a future shipment will also clear customs.

11. Customs Seizure - No Refund or Reshipment

The customer expressly acknowledges and accepts the risks associated with international importation.
To the maximum extent permitted by applicable law, where an order has been correctly
fulfilled and dispatched and is subsequently refused, permanently detained, confiscated,
seized or destroyed because of the laws, regulations or import requirements applying in the
customer’s destination country, Paragonix will not provide a refund, replacement, store
credit or reshipment.
This includes circumstances where:

  • the product is prohibited or restricted from importation;
  • the destination country requires a prescription that the customer does not possess;
  • an import permit or authorisation is required;
  • an applicable personal-import quantity is exceeded;
  • the customer fails to satisfy requirements imposed upon them by an authority;
  • a health or medicines regulator refuses admission;
  • customs refuses release of the shipment; or
  • another competent authority determines that the shipment cannot legally be released.


By completing the purchase, the customer expressly accepts this risk.
A seizure, confiscation, destruction or permanent refusal of a correctly fulfilled international shipment
does not create an obligation for Paragonix to issue a refund or dispatch another shipment.
This clause does not apply where Paragonix failed to dispatch the order, supplied a materially incorrect
product, materially misfulfilled the order or where applicable law gives the customer a right or remedy
that cannot legally be excluded

12. No Returns or Exchanges

All sales are final once an order has been dispatched, except where applicable law requires otherwise.
Paragonix does not accept returns, exchanges, refunds or reshipments because a customer changes
their mind, selects the wrong product, orders the wrong quantity, no longer wants the product, refuses
delivery, or for any other customer-choice reason.
Customers are responsible for reviewing their order carefully before completing payment and for
ensuring that the products, quantities and delivery details selected are correct.
Because the products offered through the Website may include medicines and health-related products,
returned goods may not be suitable for resale or redistribution once they have been dispatched or have
left the controlled supply chain.
A parcel being returned to Paragonix or a fulfilment provider does not create an automatic entitlement to
a refund, replacement, credit or reshipment
This section does not limit any remedy that applicable law does not permit Paragonix to exclude,
including where Paragonix has materially misfulfilled an order or supplied a materially incorrect product.

13. Lost, Damaged and Undelivered Shipments

A shipment that is lost, damaged in transit or not delivered for reasons unrelated to customs seizure will
be assessed separately from a customs refusal or confiscation.
Customers should contact Paragonix promptly where tracking indicates an unusual delay, a shipment
appears lost, a parcel arrives materially damaged or tracking shows delivery but the customer cannot
locate the parcel.
Paragonix may ask the customer to confirm delivery details, check with household members or building
management, contact the carrier where appropriate, or provide photographs and other reasonable
evidence.
Where a carrier investigation confirms loss or material transit damage, the remedy will be determined in
accordance with applicable law and the circumstances of the order.
Paragonix is not responsible for failed delivery caused solely by a materially incorrect or incomplete
address supplied by the customer, subject to any rights that cannot legally be excluded

14. Shipping and Delivery

Customers are responsible for providing a complete and accurate delivery address.
Estimated delivery periods are estimates and are not guaranteed delivery dates unless specifically
stated otherwise.
International shipments may be affected by customs processing, regulatory inspections, postal or courier
delays, public holidays, weather, transport disruption, incorrect customer information or circumstances
outside Paragonix’s reasonable control.

15. Duties, Taxes and Import Charges

Unless expressly stated otherwise at checkout, customs duties, import taxes, processing fees, handling
charges or other destination-country charges are not included in the product price.
Where such charges are legally imposed upon the recipient, they are the customer’s responsibility.
Paragonix does not control charges independently imposed by government authorities.

16. Prices and Payment

Prices displayed on the Website are shown in the currency identified during browsing or checkout and
may be changed from time to time.
Price changes will not normally affect an order already accepted.
Where currency conversion is provided, the displayed converted value may be approximate and a
customer’s bank, card issuer or payment provider may use its own exchange rate or charge additional
fees.
Payment must be made using an accepted payment method available through checkout.
By making payment, the customer confirms that they are authorised to use the chosen payment
method.
Transactions may be processed by independent payment providers and may be subject to fraud
prevention, security and verification procedures

17. Order Acceptance and Cancellation

Submitting an order through the Website constitutes an offer to purchase the selected products.
An automated order acknowledgement confirms receipt of the order but does not necessarily constitute
final acceptance.
Paragonix may decline or cancel an order before dispatch where a product is unavailable, there is an
obvious pricing or technical error, payment cannot be verified, fraudulent activity is reasonably
suspected, customer information is materially incorrect, fulfilment would be unlawful, a destination is
restricted or another material reason prevents lawful fulfilment.
Where Paragonix cancels an order before fulfilment and dispatch, payments relating to products that will
not be supplied will be handled in accordance with applicable law.

18. Refunds and Order Issues

Paragonix does not provide voluntary returns, exchanges or refunds for change of mind, incorrect
product selection, incorrect quantity selection, unwanted products or other customer-choice reasons
once an order has been dispatched.
Customers should contact Paragonix promptly if Paragonix supplied a materially incorrect product, an
order was materially incomplete, a product arrived materially damaged, or another significant fulfilment
issue occurred.
Paragonix may request photographs, packaging information, tracking information or other reasonable
evidence to investigate a genuine fulfilment claim.
International customs seizure, confiscation, destruction or refusal is governed specifically by Section 11
of these Terms and does not qualify for a refund or reshipment except where applicable law requires
otherwise.
Nothing in this section excludes a refund, replacement or other remedy that applicable law does not
permit Paragonix to exclude.

19. Laboratory Testing and Batch Verification

Where Paragonix provides certificates of analysis, laboratory reports, independent testing or batch
verification information, those documents relate only to the product identified, batch identified, sample
tested and testing parameters stated in the relevant laboratory document.
Laboratory testing does not establish characteristics that were not included within the testing performed.
A certificate of analysis or laboratory report does not constitute individual medical advice, a prescription,
a guarantee that a product is suitable for a particular individual, a guarantee of therapeutic outcome or a
guarantee concerning matters that were not actually tested.
Paragonix will not knowingly alter or materially misrepresent independent laboratory results.

20. Individual Results, Testimonials and Reviews

Individual experiences and outcomes may vary.
Testimonials, customer reviews and individual experiences displayed on the Website do not guarantee
that another customer will experience the same outcome.
Paragonix does not guarantee a particular therapeutic or health result from use of a product.
Customer reviews and testimonials should reflect genuine opinions or experiences.
Paragonix may moderate or remove content containing unlawful material, threats, abuse, personal
information, spam, fraudulent material, irrelevant content or material that infringes another person’s
rights.
Paragonix will not knowingly alter a genuine review in a way that materially misrepresents the
customer’s opinion.

21. Website Accuracy

Paragonix makes reasonable efforts to maintain accurate Website information.
The Website may occasionally contain typographical errors, technical errors or outdated information.
Paragonix may correct errors and update content where reasonably necessary.
Material restrictions or qualifications affecting a customer’s purchasing decision will not intentionally be
concealed

Unless otherwise stated, Website content is owned by or licensed to Paragonix.
This includes trademarks, logos, product names, packaging artwork, photographs, graphics, written
content, videos, Website design and other proprietary material.

Customers must not use the Website for unlawful purposes, to commit fraud, to make unauthorised
purchases, to interfere with Website security, to introduce malicious software, to gain unauthorised
access to systems or data, to impersonate another person, to unlawfully scrape information or to infringe
intellectual property or other legal rights.
Paragonix may restrict access where reasonably necessary to protect customers, the Website or the
business

24. Third-Party Services

Paragonix may use third-party pharmacists, fulfilment providers, laboratories, payment processors,
couriers, hosting providers, analytics providers and other service providers.
Third parties may have their own terms and privacy policies.
Nothing in this clause removes responsibility that applicable law requires Paragonix to retain.

25. Privacy

Personal information collected through the Website is handled in accordance with the Paragonix Privacy
Policy and applicable privacy laws.
The Privacy Policy forms part of the Website’s legal framework and should be reviewed separately

26. Electronic Communications and Contract Records

Customers agree that transactional communications may be sent electronically, including order
confirmations, payment notifications, shipping notifications, delivery updates, security notices and
customer-service communications.
Marketing communications will be handled separately and may be unsubscribed from where applicable.
Where technically available, Paragonix may retain a record of the version of these Terms accepted by
the customer together with the relevant order number, date and time of acceptance.
An order confirmation may include, attach or link to the version of the Terms applicable to the
transaction so that the customer can retain a record of them.

27. Fraud Prevention

Paragonix may undertake reasonable fraud-prevention, transaction-monitoring and identity-verification
procedures.
Orders may be delayed, refused or cancelled where Paragonix reasonably suspects fraud, payment
abuse or unauthorised activity

28. Restricted Destinations, Sanctions and Supply Restrictions

Paragonix may restrict, suspend, refuse or cancel orders to particular countries, territories or recipients
where shipment, supply or payment is prohibited or materially restricted by applicable law, sanctions,
trade restrictions, carrier requirements, regulatory requirements or other lawful compliance obligations.
The availability of a destination at checkout does not guarantee that every product can be supplied to
that destination at all times

29. Limitation of Liability

Nothing in these Terms excludes or limits liability, consumer rights or remedies that cannot lawfully be
excluded or limited.
Subject to those rights and to the maximum extent permitted by applicable law, Paragonix will not be
liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable or
directly caused by a breach attributable to Paragonix.
Paragonix is not responsible for independent decisions made by customs, border, postal, health,
medicines or other government authorities.
Nothing in these Terms excludes liability for fraud, deliberate misconduct or another liability that cannot
legally be excluded

30. Events Outside Our Reasonable Control

Paragonix will not be responsible for delays or failure caused by circumstances outside its reasonable
control, subject to mandatory legal rights.
These circumstances may include natural disasters, severe weather, war or civil disturbance,
government action, border closures, transport disruption, strikes, communications failures, major supply
chain interruption or other comparable events

31. Changes in Laws and Customs Practices

Import laws, medicine classifications, customs requirements and enforcement practices may change.
Customers are responsible for checking the requirements applying to their order at the time of purchase.
Previous successful delivery of a product does not guarantee that another shipment will clear customs.

32. Changes to These Terms

Paragonix may update these Terms from time to time to reflect changes to the Website, products,
business operations, fulfilment arrangements, payment processes or legal and regulatory requirements.
The version applicable to an order will ordinarily be the version presented to the customer when the
order was placed.

33. Mandatory Consumer Rights

Nothing in these Terms is intended to exclude, restrict or modify any statutory right, consumer
guarantee, remedy or liability that applicable law does not permit to be excluded.
Where mandatory law conflicts with these Terms, the mandatory requirement will prevail to the extent of
that conflict

34. Severability and No Waiver

If any part of these Terms is found to be invalid or unenforceable, that provision will be limited or
interpreted to the minimum extent necessary and the remaining provisions will continue to apply.
Failure by Paragonix to immediately enforce a right under these Terms does not necessarily constitute a
waiver of that right.

35. Applicable Law and Disputes

The laws applicable to a transaction will be determined by the legal rules that apply to the contracting
parties and the transaction, including any mandatory consumer protections that cannot lawfully be
excluded.
Customers experiencing a problem should contact Paragonix first so the matter can be investigated and,
where possible, resolved.
Nothing in these Terms prevents a customer from using a court, regulator, tribunal, payment dispute
process or other remedy legally available to them
